Terms and Conditions for WiFly Data Services

Welcome to WiFly, a service managed by WiFly, LLC (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the WiFly data portal, as well as our devices and services. By accessing our site, purchasing data, or using our services, you agree to be bound by these terms.

1. Overview

WiFly, LLC, headquartered in California, operates WiFly — an online platform that allows users to purchase data for use with compatible portable hotspot devices. Only devices sold directly by us or through our authorized dealers are compatible with WiFly data packages.

2. Products and Services

Our offerings include:

  • Portable Hotspot Devices: These are compact, wireless devices that provide internet access via cellular networks. Some may be sold directly by us, and others through authorized dealers.

  • Data Packages: These paid data plans are for use exclusively with WiFly-compatible devices. Activation and usage of data plans require an eligible device.

  • Complimentary Data Packages: Some devices may come with free data. These are provided as-is and may be subject to usage, expiration, or activation limits.

3. Compatibility Notice

WiFly data packages are only compatible with portable hotspot devices sold by us or our authorized dealers. Attempting to use WiFly data with other devices is not supported and may result in service failure.

4. Data Activation and Usage

We offer data packages that provide internet access through supported cellular networks. These include both complimentary and paid data packages.

  • Complimentary data packages may be included with certain WiFi devices. These are provided as-is and are not refundable, transferable, or replaceable if lost or unused.

    • Activation window: The complimentary data package must be activated within 365 days from the date of device purchase. If the data is not activated within that period, it will expire and cannot be used or reissued.

    • Usage period: Once activated, the data will remain available for 30 consecutive days. After 30 days, any unused data will expire and cannot be restored or refunded.

  • Paid data packages may be purchased for use exclusively with the WiFi devices sold by us or our authorized dealers.

    • Activation window: Paid data packages must be activated within 365 days of the date of purchase. If not activated within this time, the data package will expire and cannot be used or refunded.

    • Usage period: Once activated, the data will remain available for 30 consecutive days. After 30 days, any unused data will expire and cannot be restored or refunded.

    • Paid data packages are non-refundable once activation has occurred or any portion of the data has been used.

We do not guarantee uninterrupted service, specific speeds, or coverage in all locations. Service availability depends on carrier network conditions, signal strength, and other factors outside our control.

5. Orders and Payments

By placing an order, you confirm:

  • All information you provide is accurate;

  • You’re authorized to use the selected payment method;

  • You accept the prices and charges presented during checkout.

We may cancel or reject any order at our sole discretion.

6. Returns

We accept returns for portable hotspot devices under the following conditions. Returns for paid data packages are not accepted.

  • Return Window: Returns for portable hotspot devices must be initiated within 30 days of the original purchase date.

  • Unopened Items:
     A refund will be issued, minus a $10 return shipping fee.

  • Opened or Used Items:
    A refund will be issued, minus:
    (1) a $10 return shipping fee,
    (2) a $10 restocking fee, and
    (3) charges for any portion of the complimentary data package that was used.
     The amount deducted for used data will be calculated based on our standard data pricing at the time of return.

  • Condition:
    All returned devices must include the original accessories and must be returned in good, working condition.

  • Return Authorization:
    You must contact us at info@wifly.us prior to returning any item. A return shipping label and instructions will be provided. Returns sent without prior authorization may not be accepted.

  • Refund Processing:
    Refunds will be processed once the returned item has been received and inspected.

7. Warranty and Repairs

Our devices are covered under warranty for manufacturing defects for the earlier of:

  • Four (4) weeks from the date the device was first activated, or

  • Three (3) months from the date of purchase

The warranty does not cover damages caused by misuse, accidents, or unauthorized modifications.

After the warranty period, or if repairs are needed due to damage you caused, a paid repair service is available. Please contact us to inquire about repair service fees and details.

8. Restrictions on Use

You agree to:

  • Use our data services and devices lawfully;

  • Not resell, redistribute, or tamper with data packages or devices;

  • Not attempt to use our data packages on unsupported or non-WiFly devices.

We reserve the right to suspend or terminate service if we detect misuse or abuse of our network or devices.

9. Intellectual Property

All content created, published, or distributed by WiFly, LLC—including but not limited to website content, product descriptions, images, logos, promotional materials, flyers, posters, email content, and other marketing or branding assets—is the property of WiFly, LLC and may not be copied, modified, or reused without our prior written permission.

10. Limitation of Liability

We are not liable for indirect or consequential damages arising from your use or inability to use our services. This includes, but is not limited to, loss of data, income, or business opportunities due to service interruptions.

11. Eligibility

To use our services, you must be at least 18 years old, or have the permission of a parent or legal guardian. If you are under 18, your use of our services must be supervised by an adult.

12. Dispute Resolution

Any dispute arising from these Terms or your use of our products and services will be resolved through binding arbitration in Los Angeles County, California.

You agree to waive any right to bring or participate in a class action lawsuit or class-wide arbitration. Each dispute will be handled on an individual basis.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any arbitration or legal proceeding shall be conducted in Los Angeles County.

14. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page. Continued use of our services after an update constitutes your acceptance of the revised Terms.
